Terms of Use
These terms are the agreement between you and us for the Domicile app and service. They also serve as the end-user licence agreement for the app.
Draft for legal review · version 2026-10-19 · not yet in force
The agreement
Domicile is provided by Ohmic Ventures LLP (LLPIN ACX-7347), No 15, MR Garden, VNH, RT Nagar Post, Bangalore 560032 ("we", "us"), which is the party you contract with and which receives subscription payments through Apple or Google. You accept these terms when you tap to agree in the app. If we change them materially, the app shows the new version and asks you to accept it before it applies; if you do not, you can export your data and close your account. The Privacy Policy and the Subscriptions and refunds policy form part of these terms.
Words we use
- Account: your Domicile sign-in and everything synced to it.
- Record: the trips, travel events, answers and documents in your account.
- Evidence: scans, files and imported details you attach to your record.
- Report: any export, PDF, spreadsheet or summary the app produces.
- Rule set: our encoding of a country's residency tests, with its version.
- Subscription: Domicile Pro, bought through the App Store or Google Play.
Who can use Domicile
You must be 18 or older and able to make a binding contract. You may hold one account for yourself. You may record another adult's travel only with their permission.
What Domicile does
Domicile helps you keep a record of where you have been and compare it with residency rules. It lets you:
- record trips by hand, by scanning boarding passes, passports, tickets and PDFs, by forwarding booking emails to your Domicile address, and by importing travel details from Google Calendar if you connect it;
- review and correct anything found before it becomes part of your record;
- see day counts per country and per tax year, countdowns and alerts before thresholds, and the result of each rule set's tests where Domicile has full residency tests for that country;
- apply India's residential status tests, including resident but not ordinarily resident (RNOR), and the other countries listed on How we count;
- plan future trips and see their effect; and export PDF, spreadsheet and CSV reports to share with your adviser.
Some rule sets are still drafts (listed on How we count); they show day counts and possible thresholds but no residency result. Features that depend on Google, Apple, OpenAI or your phone's sensors work only while those services do.
Not advice, not a certificate
- Domicile counts days and applies the rules as we have encoded them. It does not decide your legal tax residency and is not tax, legal, immigration or financial advice. No adviser–client relationship is created.
- Residency often depends on more than days: citizenship, visa status, a home, family, work, income and treaties. Tax residency, immigration status and residential status under India's Foreign Exchange Management Act are separate questions with different tests; Domicile addresses tax residency day tests only.
- Results depend on the accuracy and completeness of your record and on the version of the rule set used. Imported itineraries show what was booked, not that you travelled; flights are cancelled, missed and changed.
- Reports are your own records. They are not government certificates, and no authority is bound to accept them.
- Confirm important decisions with a qualified professional before you act.
Your responsibilities
- Give accurate information, review what is imported or calculated, and correct missing or contradictory entries.
- Keep your own supporting evidence (passport stamps, boarding passes, tickets) in case you need to prove your travel.
- Keep your sign-in secure and tell us promptly at support@domicile.live if you think someone else has used your account.
- Connect only accounts and upload only documents you are entitled to use.
Acceptable use
You must not: create or upload false or altered evidence, or use Domicile to mislead a tax or immigration authority; impersonate anyone or use another person's data without their authority; break the law or infringe anyone's rights; try to reach other users' data, probe or bypass our security or rate limits, or overload the service; copy, scrape, resell or reverse engineer the service or its rule sets except where the law allows it; or use automated means to access the service other than the app. We may investigate suspected misuse and suspend access while we do; we will tell you why unless the law or an investigation prevents it, and you can reply to support@domicile.live to dispute it.
Subscriptions
Domicile Pro starts with a 7-day free trial and then costs US$49 a year, or the local price the store shows, renewing automatically until you cancel in the store. Without an active trial, subscription or code, the app opens only to its subscription screen, from which you can still export your data, sign out or delete your account. Codes are personal, may expire or have a use limit, have no cash value and may be withdrawn if misused. Billing, cancellation and refunds are covered in Subscriptions and refunds.
Your data and our licence
Your record is yours. You give us a licence to store, process and display it only to provide the service to you, as described in the Privacy Policy, for as long as it is in your account. You can export it at any time. If you send us feedback, we may use it without obligation to you. We do not create aggregated or anonymised statistics from your record.
Our software
The app, the rule sets, the design and the name Domicile belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for your own records, while your account is open. Reports may be shared with your advisers and authorities but not sold or offered as a service to others.
Other services
Signing in with Google or Apple, importing from Google Calendar, reading forwarded email, store billing and the planning assistant depend on other companies' services and terms. We are not responsible for those services, but we choose them carefully and they process data for us only as the Privacy Policy describes.
Changes and availability
We update rule sets when laws change and record the version each result used. We may add, change or remove features; if a change removes something material that you have paid for, you may cancel and ask for a refund under the Subscriptions policy. We aim to keep the service available but do not promise it will be uninterrupted or error-free. Your record stays on your phone if our server is unavailable.
Suspension and closing
You can delete your account at any time in Profile. We may suspend or close an account for serious or repeated breach of these terms, a security threat, non-payment, or where the law requires it, with notice where possible. When an account closes we delete its data as the Privacy Policy describes; export first if you want a copy. A store subscription is not cancelled by deleting your account: cancel it in the store.
Liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer. Subject to that: the service is provided as is; we are not liable for losses caused by your reliance on day counts or results without professional advice, by inaccurate or incomplete data you provide, or by events outside our reasonable control; and our total liability to you for any claim is limited to [counsel: e.g. the amount you paid in the 12 months before the claim].
Law and disputes
These terms are governed by the laws of [governing law], and the courts of [jurisdiction] have jurisdiction, but if you are a consumer you keep the protection of the mandatory laws of your country of residence and may bring claims in your local courts. Please contact us first; most problems can be solved quickly. [Counsel: arbitration or ODR clause if wanted; Indian Consumer Protection Act, EU ODR notice.]
App Store terms
If you downloaded Domicile from Apple's App Store: these terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support; if the app fails to conform to any applicable warranty you may notify Apple for a refund of its purchase price and, to the extent the law allows, Apple has no other warranty obligation; Apple is not responsible for any claims relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims; Apple is not responsible for investigating or settling any claim that the app infringes a third party's intellectual property; you confirm you are not in a country subject to a US Government embargo or on a US Government list of prohibited or restricted parties; you must comply with applicable third-party terms when using the app; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
